Treaty to Settle Claims which Switzerland has
against Japan translated from the French and Japanese
originals into German signed 21 January 1955 ratified 26 March
1955
Article I
The government of Japan will pay the Swiss government a global sum
12,250,000 Swiss francs, at latest 1 month after ratification in
settlement of damage to assets committed by Japanese entities in WWII to
Swiss people, legal entities and limited companies, for which government
of Japan is liable under International Law. Those who have a claim must
have been Swiss nationals when the damage occurred and when this Treaty is
signed.
Article II
The government of Japan agrees to the action which the Swiss government
took in 1949 to take over Swiss francs 2,426,693 from
Japanese deposits and used and distributed as settlement for personal
injuries which Swiss nationals experienced in WWII from the
Japanese. This money was paid strictly to persons.
Article III
The Swiss government is responsible to distribute the amount in Article
I amongst the entities mentioned. Distribution does not imply legal
responsibility on the part of Switzerland or Japan. As soon as the amount
is paid the Swiss government will renounce all claims in connection with
damages in Articles I and II and Swiss nationals will bring no further
claims against the Japanese government.
Article IV
To facilitate payment in Article I the Swiss government will lift the
freeze on Japanese money up to the agreed amount and once payment is
received all other Japanese money deposited in Switzerland will be
freed.
Article V
This agreement also applies to Liechtenstein nationals, legal entities
and limited companies.
Article VI
Implementation of this agreement will be agreed in a separate paper
between Swiss and Japanese authorities.
Article VII
This treaty will be ratified on a date which governments will have to
agree in writing. \the aim is before 30 April, 1955.
